Understanding Assault Charges In Pennsylvania

Being charged with assault is a serious matter, especially in the state of Pennsylvania. It is important to understand the different classifications of assault charges, what constitutes aggravated and simple assault, and the consequences of being convicted. At Aegis Law, LLC we are here to provide legal assistance to individuals facing assault charges. Let’s dive into the details surrounding this topic.

Classifications of Assault Charges in Pennsylvania

In Pennsylvania, there are three main categories that encompass all types of assault charges—simple assault, aggravated assault, and vehicular assault. Simple assault is considered a misdemeanor offense while aggravated and vehicular assaults are more serious felonies. Depending on the severity of the crime and any prior criminal history, an offender can receive various sentences ranging from probation to a lengthy prison sentence.

What is Aggravated Assault?

Aggravated assault occurs when an individual purposely or knowingly causes bodily injury to another person with extreme indifference to human life or attempts to cause serious injury with a deadly weapon such as a firearm or knife. This type of charge carries the harshest penalties because it involves intentional harm or attempts at harm by use of dangerous weapons. If convicted, an offender can face prison time for up to 20 years depending on circumstances and prior convictions.

What is Simple Assault?

Simple assault occurs when an individual either intends to cause fear in another person through physical contact or causes minor bodily harm without using a deadly weapon such as pushing someone during an argument or punching someone during a fight. Offenders can be punished with jail time for up to two years however; some cases may be downgraded from felony status if there is lack of evidence proving intent or if it was determined that self-defense was involved in the altercation.

Consequences of Being Convicted of Assault Charges in Pennsylvania

The consequences for being convicted on an assault charge can be quite severe and will depend on whether it was classified as a felony or misdemeanor offense and any prior criminal history associated with that individual. There could be fines imposed along with jail time ranging from 1 year for misdemeanors up to 20+ years for felonies depending on circumstances and aggravating factors such as use of weapons during the commission of the crime.. In addition, one could have their license suspended and be required to attend anger management classes as part of their punishment even if they are not ultimately convicted..
